ARC Weekly Challenge Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. Josie Lewis Social Media Giveaways (each, a “Giveaway”) is sponsored by Josie Lewis Art LLC (“Josie Lewis”). “You”, “your”, or “Entrant” means any eligible participant in the Giveaway. Participation constitutes Entrant’s full and unconditional agreement to and acceptance of these Official Rules. The information below outlines the Giveaway Period and other specifics for this Giveaway.

GIVEAWAY PERIOD. The Giveaway begins at 12:01 am Central Time on October 7th  2023, and ends at 11:59 pm Central Time on December 31st , 2023.  During the Giveaway, there will be 12 weekly drawing  (the “Giveaway Period”) and consists of one (1) Prize as defined below being awarded each week to entries in the ‘weeks challenge’ (refer to Table 1).

PRIZE. The drawing for the prize listed below (the “Prize”) will occur on or about 12:00 pm on each Friday of the giveaway period (the “Drawing Date”), where one winner will be entitled to the following Prize: Amazon Gift Card

The approximate retail value of the Prize is $25 USD.

ELIGIBILITY. The Giveaway is open to all people that are 18 years of age or older at time of entry that have an active ARC membership in good standing. (Each eligible person to enter is, an “Entrant”). Employees of the Josie Lewis, advertising, promotion, and fulfillment agencies, and members of the immediate family (e.g., spouse, parent, child, sibling, and their respective spouses and “step” family members of each) or persons living in the same household of each of the above, whether or not related, are not eligible to enter or win.

HOW TO ENTER. To enter, Entrant must post or comment a response to Josie’s weekly challenge questions on the ARC Private Facebook Group using the instructed hashtag for that week’s drawing during the “Giveaway Period” stated (an “Entry”). By submitting an Entry, the Entrant elects to “opt-in” to these Official Rules. No purchase necessary to enter or win. Limit one (1) entry per person; multiple entries will not increase chances of winning and may result in Entrant’s entry being filtered out and/or disqualified and declared null and void in Sponsor’s sole discretion. The name of the Entrant must be the name of the authorized account holder of the account used in the entry, or the entry may be deemed void. In the event of a dispute over the identify of an Entrant or potential winner, including multiple individuals using the same account, the entry will be deemed made by the authorized account holder of the account used for the entry, and the Entrant may be required to provided identification sufficient to show that they are the authorized account holder. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. Entries containing offensive, obscene, derogatory, lewd, or other inappropriate content, as determined by the Sponsor in its sole discretion, are prohibited and will be disqualified. All entries must be received by the Giveaway Period deadline above. Entrants assume all risk of lost, late, misdirected, incomplete, or illegible entries.

PRIZE AND ODDS OF WINNING. One (1) winner will be selected by random drawing on or about the Drawing Date stated above. The Prize description and quantity is stated above. The Prize is as specifically listed above. The odds of winning the Prize are dependent upon the number of Entries. The random drawing and awarding of the Prize will be conducted under the supervision of Josie Lewis whose decision is final and binding in all matters pertaining to this Giveaway. Entrants agree to be bound by these Official Rules as a condition of entering the Giveaway.

MOBILE DISCLOSURE: If you opt to use your wireless mobile device in connection with this Giveaway, standard rates or data charges may apply according to the terms and conditions of your service agreement with your wireless carrier. Other charges may apply (such as normal airtime and carrier charges) and may appear on your mobile phone bill or be deducted from your prepaid account balance. Wireless carriers’ rate plans may vary, and you should contact your wireless carrier for more information on rate plans and charges relating to your participation in this Giveaway.

NOTICE AND ACCEPTANCE. The Prize winners will be announced publically the day following the drawing within the ARC Weekly Newsletter email and the winning Entry and must reply to the notification within 14 days, or the Prize will be forfeited. In the event of any noncompliance, if the winner cannot be reached, or if the Prize is returned as unclaimed or undeliverable, the Prize will be forfeited. No substitution of any Prizes will be offered, and the Prize is personal to the winner and cannot be transferred. If the Prize is unavailable, Josie Lewis reserves the sole right to substitute a prize of equal or greater value. All costs or taxes associated with the Prize are the sole responsibility of the Prize winner. By participating and accepting the Prize, where permitted by law, each winner grants to Josie Lewis (and agrees to confirm that grant in writing) and those acting pursuant to the authority of Josie Lewis or as its designee or licensee, the right to record, print, publish, broadcast, use, create derivative works from, reproduce, distribute, display, perform, and modify worldwide in any medium now known or hereafter developed, including but not limited to the World Wide Web, social media, or streaming, at any time(s), the winner's name, portrait, picture, voice, likeness, city and state of residence, biographical information, and other information and content provided in connection with the Giveaway as news or information and for advertising, promotional, trade, commercial, and publicity purposes without additional compensation or review. By submitting an Entry, Entrant consents to the collection and sharing of certain data submitted to Josie Lewis, which may include, but is not limited to, personally identifiable information. Entrant hereby submits to the collection of data by social media platforms, Josie Lewis, and each of their respective affiliates and sharing of such information with or by such parties. Josie Lewis may use such information for any lawful purpose, including, but not limited to, marketing goods and services to you. All information shared with or via a social media platform or Josie Lewis by Entrant in connection with this Giveaway will be maintained in accordance with the relevant social media platform’s privacy policy and Josie Lewis’ website privacy policy, which can be found at https://josielewis.com/terms-1.

Entrant consents to such social media platform and Josie Lewis using Entrant’s personal data as provided herein. At all times, Entrant must comply with all applicable laws, rules, and regulations, including without limitation the rules or policies which may be promulgated by Josie Lewis from time to time. Prize awarding is contingent on permissibility based on applicable federal, state, and local laws, rules, and regulations. Entrant is responsible to comply with all applicable federal, state, and local laws, rules, and regulations that may govern activities associated with the awarding of the Prize. Entrant is responsible for consulting with its own tax advisor and understanding any tax implications in connection with accepting the Prize.

RELEASE OF LIABILITY. By participating in the Giveaway, Entrant agrees to hold harmless and release Josie Lewis Art LLC and its representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, website providers and hosts, social media providers, and their respective parent companies, affiliates, subsidiaries, officers, directors, agents, employees, and all others associated with the development and execution of this Giveaway from any and all liability with respect to or in any way arising from this Giveaway and acceptance, possession, use, or misuse of the Prize or any substitute prize, including but not limited to liability for personal injury, bodily injury including wrongful death, damage to property, and damage or loss of any other kind resulting from participating in the Giveaway and/or accepting a prize. Josie Lewis is not responsible for Prize quality or utility. Josie Lewis is not responsible for any incorrect or inaccurate information, whether caused by social media users, by any of the equipment, software, hardware, or programming associated with or used in the Giveaway, or by any technical or human error that may occur in the processing of submissions in the Giveaway. Josie Lewis assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications-line failure, theft, destruction, lost, late, incomplete, misdirected, unauthorized access to, or alteration of entries. Josie Lewis is not responsible for any problems or technical malfunction of any telephone, satellite, cable, network, or lines, computer online systems, servers, or providers, computer equipment, computer software, or failure of entry on account of technical problems, including, but not limited to, any garbled, corrupt, or jumbled transmission, failure to capture, or any error, omission, interruption, deletion, defect, or delay. Josie Lewis is not responsible for user cheating or fraud by any Entrants. Any activities intended to disrupt or interfere with the proper play of the Giveaway or defraud Josie Lewis in any way will be prosecuted to the fullest extent of the law. Entrants who engage in any of the foregoing activities will be disqualified and will forfeit any prizes won. If, for any reason, the Giveaway is not capable of running as planned, due to, but without limitation, infection by computer virus, worm, or bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Josie Lewis, that in the sole opinion of Josie Lewis, could corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Giveaway, including the selection of a winner in a manner Josie Lewis deems fair and reasonable, Josie Lewis reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Giveaway. In no event will more prizes be awarded than are stated in these Official Rules. In the event that, due to technical, typographical, mechanical, administrative, printing, production, computer or other errors, there are more winners than are stated in these Official Rules, Josie Lewis shall immediately suspend all drawings and prize awards, and Josie Lewis reserves the right to award any remaining prizes (up to the total set forth in these Official Rules) in a manner deemed fair and equitable by Josie Lewis, such as by way of example and not by way of limitation, in a random drawing from among all eligible, non-suspect entries received up to the time of the impairment, and Josie Lewis shall not have any further liability to any entrant in connection with the Giveaway. Josie Lewis may modify and amend these Official Rules as they appear online from time to time during the Giveaway Period for clarification purposes without materially affecting the terms and conditions of the Giveaway.

WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS GIVEAWAY, INCLUDING THE PRIZE, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

DISPUTES. THIS GIVEAWAY IS GOVERNED BY AND WILL BE CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF MINNESOTA. As a condition of participating in this Giveaway, Entrant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively by arbitration in Hennepin County, State of Minnesota under the Arbitration Rules and Procedures of JAMS, except that the JAMS rules for selection of an arbitrator shall not be followed if any arbitrator to be selected would not otherwise be experienced and licensed to practice law in the State of Minnesota. Further, in any such dispute, under no circumstances will Entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, exemplary, special, or consequential damages, including, but not limited to, reasonable attorney fees. Entrant’s sole recovery, if any, shall be Entrant’s actual, out-of-pocket expenses incurred in connection with entering this Giveaway, not to exceed Fifty and 00/100 USD ($50.00), and Entrant further waives all rights to have damages multiplied or increased. Any demand for arbitration must be filed within one (1) year from the end of the Giveaway Period, or the cause of action shall be forever barred.

GENERAL TERMS. Any attempted form of participation in this Giveaway other than as described herein is void. Josie Lewis reserves the right to disqualify any entrant found or suspected, in its sole and absolute discretion, to be tampering with the operation of the Giveaway; to be acting in violation of these Official Rules; or to be acting in an unsportsmanlike manner or with the intent to disrupt the normal operation of this Giveaway. If it is discovered that a person has registered or attempted to register more than once using multiple accounts, phone numbers, email addresses, residential addresses, multiple identities, IP addresses, use of proxy servers, or like methods, all of that person’s entries will be declared null and void and that person will not be awarded any prize that he or she might have been entitled to receive. Any use of robotic, automatic, macro, programmed, third party or like methods to participate in the Giveaway will void any attempted participation effected by such methods and the disqualification of the individual utilizing the same. ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, JOSIE LEWIS RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. If any provision of these Official Rules or any word, phrase, clause, sentence, or other portion thereof should be held unenforceable or invalid for any reason, then that provision or portion thereof shall be modified or deleted in such manner as to render the remaining provisions of these Official Rules valid and enforceable. The invalidity or unenforceability of any provision of these Official Rules or the prize documents will not affect the validity or enforceability of any other provision. No Entrant shall have the right to modify or amend these Official Rules. Josie Lewis’ failure to enforce any term of these Official Rules shall not constitute a waiver of that provision and such provision shall remain in full force and effect. In the event of any conflict with any promotion details contained in these Official Rules and Giveaway details contained in any promotional materials (including but not limited to point of sale, television and print advertising, promotional packaging and other promotional media), the details of the Giveaway as set forth in these Official Rules shall prevail. All federal, state, and local laws apply. Void where prohibited or restricted by law.
